Residency Requirements

Spouses have the right to file for divorce, provided that one of them has been a state resident for at least six months before filing a lawsuit with the court.

The plaintiff can file for divorce in the county in which either spouse resides, provided that they are both residents of Mississippi.

Otherwise, the court proceedings must take place in the county of the plaintiff.
